You acknowledge that by making a booking you have read, understood and agreed to the Booking Terms and Conditions.

ETHICS STATEMENT

All readings are confidential and will never be shared with anyone without the client’s permission.

Readings are conducted to the best of the readers ability with honesty, love, supportive intentions and compassion. Messages are channelled using a range or modalities, please discuss with your reader if you would like more clarity on their process.

Readers are not fortune tellers but offer guidance for yourself in the present moment and into the near future. Reading may be focused on but not limited to messages for your higher self, current state, love, work, money, health and situational outcomes.

You acknowledge that any and all predictions of the future are not guaranteed outcomes. The predictions are expressions of opinion only. The predictions are based on the current events and the outcome can be influenced by your decisions and choices you make by your free will from the moment the reading is delivered to you.

TERMINATION BY THE READER OR DANYA

You agree that The Reader or Danya is entitled to cancel or terminate a reading at any time (including at any time during a reading) for any or no reason.

PARTICIPATING IN PSYCHIC READINGS

You understand that participating in a psychic reading can be (and often is) an emotional and potentially confronting experience.

You acknowledge that you are choosing to have a psychic reading and that the reading will be given to you in good faith to provide you with insight and guidance of thought – it is subject to your own personal interpretation and is not intended to constitute medical, psychological, legal, financial, relationship, personal or professional advice.

You acknowledge that insights, guidance and psychic reading experiences may vary from person-to-person and reading-to-reading, so whilst we will ensure The Reader or Danya uses their best endeavours to utilise the full potential of their gift and ability when engaging in a psychic reading, you acknowledge that due to the nature of such readings we cannot (and do not) guarantee the accuracy, completeness or applicability of The Reader or Danya’s reading, and you may not receive answers to specific questions or areas of your life in relation to which you wish to obtain guidance.

You agree to act respectfully and in good faith in connection with each reading, you agree to participate in each reading with an open mind (understanding that your reading may address topics that are not directly requested by you, or can be interpreted in multiple ways) and you agree not to deliberately mislead or lie to The Reader or Danya or otherwise disrupt any reading.

You warrant and promise that you are in a stable and healthy frame of mind and/or you are not aware of any reason (health-related or otherwise) why you should not participate in a psychic reading.

NO RECORDING OR FILMING BY YOU

You agree you must not (and you must not allow others to) record, film or otherwise capture any reading under any circumstances, and you acknowledge that the use of recording devices can interfere with readings.

If it comes to the attention of The Reader or Danya or us (or The Reader or Danya or we otherwise suspect) that a reading is being recorded, filmed or otherwise captured, you grant us the right to take possession of the device and/or item capturing (or suspected of capturing) the reading and to search for and delete and/or destroy the recording or other captured representation of the reading without any compensation to you. You also agree that The Reader or Danya may immediately cease the reading in such circumstances and you shall not be entitled to a refund.

You acknowledge that the recording and broadcasting of readings is valuable to The Reader or Danya, as is The Reader or Danya’s reputation, and (without limiting any other remedies available to us or The Reader or Danya) you agree that you will pay us $50,000 if you are found to have recorded a reading and/or broadcast (or otherwise published, shared, disseminated or communicated to a third party) a recording of a reading (or allowed any person to do the same) and/or made any comment that is in breach of clause 10 of these Booking Terms and Conditions.

NO RESPONSIBILITY FOR YOUR ACTIONS

The Reader or Danya take no responsibility (and shall not be liable) for any decisions you make or actions you take as a result of your psychic reading and (to the extent permitted by law) you release us and The Reader or Danya from any and all liability that may arise in connection with your participation in your reading.

You acknowledge that The Reader or Danya will not provide recommendations, give you directions or advise you on decisions to be made (or actions to be taken) by you and you agree that any personal insights or opinions communicated to you by The Reader or Danya will not be relied on by you.

CONFIDENTIALITY AND NON-DISPARAGEMENT

You and we agree that the matters discussed in your psychic reading are confidential and will be treated as such by you and us (and The Reader or Danya). You also agree to keep all other confidential matters relating to your booking and reading confidential. It is agreed that any confidential information may only be disclosed if required by law or if required for the purpose of seeking professional legal advice (where such adviser is bound by confidentiality).

You agree that you will not make (or authorise) any comment or representation that may disparage, defame or negatively affect us, The Reader or Danya or The Reader or Danya’s reputation (including any negative and/or misleading comments regarding the content of any reading).

Without limiting the foregoing, you agree that you may not make any false or misleading representations, or otherwise make untruthful comments, regarding your reading or The Reader or Danya. If you wish to share or disclose your reading experience (or any related matter) with any representative of any media outlet, network or publisher, you must obtain our prior written consent (which may be withheld at our absolute discretion).

CONTINUING OBLIGATIONS

You and we acknowledge that the obligations and promises set out in the clauses are continuing obligations and survive termination and/or conclusion of the agreement between you and us, and termination or conclusion of such agreement will not affect those provisions set out in these Booking Terms and Conditions which by their nature are intended to survive termination or conclusion.

INTERPRETATION

Suppose any part of these Booking Terms and Conditions are rendered invalid by a competent court of law. In that case, these Booking Terms and Conditions (or the relevant part or provision) shall, to the extent necessary, be read down or deemed to be removed and the remaining provisions shall remain in force. The laws of the state of Victoria, Australia, govern these Terms and Conditions.

CANCELLATION POLICY, RETURN POLICY, AND REFUND POLICY

If, for any reason (illness or personal), the reader is not available or able to do your reading, you will given the option to reschedule or receive a full refund.

No cancellation or changes can be made to the booking within 24 hours of the booking. No shows and late cancellations will not be refunded.

No refunds will be issued after the reading has taken place. Any concerns post-reading, please get in touch with the team at Danya Clairvoyant on [email protected] no later than 48 hours after the booking.

The readers, staff or Danya are not responsible for your emotional and/or mental reaction to the reading. There are no exceptions.

PRIVACY POLICY.

• The Company is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.
  We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

• We collect your Personal Information for the primary purpose of providing our services to you and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.
• When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.
• Sensitive Information  is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information. We do not collect Sensitive information
• Your Personal Information may be disclosed in a number of circumstances including the following:
• Third parties where you consent to the use or disclosure; and
• Where required or authorised by law.

• Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.
• When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.
• You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing;

• In order to protect your Personal Information, we may require identification from you before releasing the requested information.

If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.
